IL Dept. of Corrections on the Hot Seat for Allegedly Refusing FOIA Requests

CHICAGO, IL – Prison Legal News (PLN) filed a lawsuit today in the Circuit Court of Cook County against the Illinois Dept. of Corrections (IDOC), alleging violations of the state’s Freedom of Information Act (FOIA).  PLN, a monthly news publication that reports on criminal justice-related issues, is a project of the Human Rights Defense Center

On March 27, 2015, PLN filed public records requests seeking documents related to a number of services provided to Illinois state prisoners, including telephone, email, video visitation, money transfer, inmate package, commissary and other services, which are typically contracted to for-profit companies.

For example, the IDOC’s inmate phone services are provided by Securus Technologies. In fiscal year 2012, Securus paid $12.9 million in “commission” kickbacks to the IDOC as part of its monopoly contract with the state. The IDOC charges $3.55 for a 15-minute call made from a state prison – rates that are overwhelmingly paid by prisoners’ family members.

PLN sought copies of the contracts for various inmate services, as well as the amount of “commission” payments the IDOC has received from its contractors. In response, the IDOC aggregated the separate requests into one, and then stated the production of the documents would be unduly burdensome. They then ignored a follow-up response.

According to PLN’s suit, “… IDOC has denied PLN’s requests not because of the alleged burden but because IDOC knows that PLN will use the information to expose profiteering at the expense of the incarcerated and their families.” PLN referred to for-profit contracts that monetize prison services – even basic communication between prisoners and their families – as a “large and lucrative industry.” The contracts and commission data are being sought as part of the Human Rights Defense Center’s Stop Prison Profiteering campaign and its Campaign for Prison Phone Justice, www.phonejustice.org.

“Not only is the Illinois DOC colluding with hedge fund-owned telecommunications companies to monetize human contact among prisoners’ families, but they are actively obstructing efforts  by the media to report the nature and extent of this monetization,” said PLN editor Paul Wright. “Given the long history of corruption in Illinois contracting, transparency and openness should be welcomed by the prison system, not obstructed.”

“The Illinois FOIA makes clear that it is the right and duty of the public to monitor government to ensure it is being conducted in the public interest,” said attorney Matthew Topic of Loevy & Loevy Attorneys at Law. “Rather than spend a few hours gathering and producing these records, IDOC makes the outrageous claim that the issue is not important enough to justify the alleged ‘burden’ of complying with the law.”

Noting that all of the requested documents “pertain to the receipt or use of public funds and therefore are per se non-exempt,” and claiming the IDOC has “willfully and intentionally violated” the Illinois Freedom of Information Act, PLN’s suit requests declaratory and injunctive relief, including production of the records, as well as civil penalties, attorneys’ fees and costs.

Father Michael L. Pfleger Sunday said the controversy over whether Sandra Bland, the 28-year-old woman found dead in her Texas jail cell, was a suicide or not is not an issue with him because she was first “hung by racism.”

Father Pfleger was saddened over the funeral of Bland, who moved from Naperville, Illinois to Texas where she was going to start a new job at her alma mater. Her funeral was held at the DuPage African Methodist Episcopal Church in Lisle, Illinois.

Bland was pulled over by a Texas police who accused her of improper lane change. The police cam shows the officer pulling out his Taser gun and threatening to “light” her up if she didn’t get out of the car. She was arrested and three-days later found hanging in her jail cell. Texas officials say she committed suicide.

“Yesterday morning I was very saddened because of the burial of Sandra Bland,” said Pfleger before preaching his sermon. “Sandra was here in this church when Common was here…took pictures with him and put it on her Facebook page saying what a tremendous time she had.”

As news of her death continue to top the news across the nation especially allegations that she committed suicide, Pfleger said, “That was really not the issue with me because she was first hung by racism. She was hung when she was pulled over and was abused verbally and dragged out of her car for changing lanes.

“I couldn’t help but think…that yesterday was the birthday of Emmett Till and here we are all those years later still watching our children killed. It’s a sad day for America,” said Pfleger.

Till was born on July 25, 1941 in Chicago but was murdered on August 28, 1955 in Money, MS where he was visiting with his relatives. The husband and brother of a white female store clerk killed the 14-year-old youth because he whistled at his wife.

WASHINGTON – U.S. Senator Mark Kirk (R-Ill.) applauded the Senate’s 67-26 vote to invoke cloture on his legislation to reauthorize and reform the Export-Import Bank. A vote on final passage of Kirk Amendment #2327 to the highway bill will be held tomorrow, Monday, July 27th.

“The Kirk-Heitkamp bill to keep the Ex-Im Bank open cleared a major hurdle today, and we are one step closer to keeping American jobs here in America and not lost to countries like China.”


Senator Kirk and Senator Heidi Heitkamp (D-N.D.) introduced the Export-Import Bank Reform and Reauthorization Act (S. 819) earlier this year. In a test vote on the bill in the form of a Kirk amendment to the National Defense Authorization Act, 65 Senators supported reauthorizing Ex-Im, and Senator Kirk worked to get today’s vote in order to reauthorize the Bank, whose charter expired June 30th.  The U.S. Chamber of Commerce and the National Association of Manufacturers are in support of the Kirk-Heitkamp legislation.

Nearly 90 percent of Ex-Im’s transactions each year directly benefit small businesses, and nationwide the bank supports more than 205,000 American jobs, including 47,000 in Illinois. The top Illinois companies supported by Ex-Im are The Boeing Company, CNH Industrial America and Caterpillar. The Export-Import Bank supports 244 Illinois businesses, such as Boeing, and operates with no cost to the taxpayer. In the past three years, the bank has returned nearly $3 billion to the U.S. Treasury. The Congressional Budget Office has estimated that the Kirk-Heitkamp bill would save taxpayers $2.3 billion.

Greenline Wheels management shifts to Active Trans

CHICAGO, IL— Greenline Wheels, founded in 2010 by a local family seeking to elevate the bike friendliness of the Oak Park/River Forest community, announced today that is has partnered with the Active Transportation Alliance in a management agreement to further advance its mission.

Beginning in August, 2015, the Active Transportation Alliance will assume day-to-day management of Greenline Wheels, with an eye toward increasing bike education, encouragement and safety programming beginning in 2016. The Greenline Wheels office will remain at 105 South Marion Street in Oak Park, but education programs will also be offered in nearby suburbs and the West Side of Chicago.

Active Transportation Alliance is non-profit organization that strives to create communities that are healthy, vibrant and environmentally friendly through better biking, walking and transit. Active Trans works throughout metropolitan Chicago, and it has more than 7000 members. In Oak Park, Greenline Wheels and Active Transportation Alliance have collaborated to advocate for better bike facilities and to deliver bike safety training at District 97 elementary schools through the “Kids on Wheels” program.
