Clifford Law Receives $11.4 Million settlement for injury case at Union Pacific facility

Robert A. Clifford, senior partner at Clifford Law Offices, settled an injury case for $11.4 million on behalf of a 57-year-old mechanic who was run over by a tractor-trailer in a Union Pacific yard while he was performing repairs on the vehicle.  The incident occurred in an area of the Chicago Union Pacific Global One railroad yard designated by Union Pacific for conducting such repairs.

Richard Naklicki of Chicago’s south side suffered severe internal injuries and orthopedic injuries following the incident on April 4, 2007.   The settlement also includes a loss of consortium claim for his wife Kazirmiera.

Naklicki, a mechanic for U.S. Intermodal, Inc., was in the process of repairing marker lights which are on the side of the truck’s chassis.  While Naklicki was working under the truck, the driver drove off and Naklicki suffered crush injuries. 

“The injuries sustained by Mr. Naklicki were tragic and absolutely preventable,” Clifford said following the settlement.  “The changes in the procedures that followed this occurrence, although they cannot help Mr. Naklicki, have enhanced safety in the railroad industry.”  Michael S. Krzak, partner at Clifford Law Offices, and Sean P. Driscoll, associate at the firm, also handled the matter on behalf of the plaintiffs.

Cook County Circuit Court Judge James Flannery signed the dismissal order of the case against defendants Union Pacific, Glenn Whiteside, Ford Dearborn Trucking Company and Miken Cartage, Inc.  (Case No. 07 L 003959)
